Terms of trade

OTOCUBE LIMITED PRODUCT WARRANTY

OTOCUBE guarantees that the the product including spare parts used by authorised personnel are free from defects in materials and workmanship under normal use for a period of six months from the date of delivery to the buyer, excepting that operation of the dedicated audio logical software may not be completely uninterrupted or error free.

This warranty only concerns the hardware of the product and not the software.

The product is only to be used by trained personnel and with the dedicated audio logical software for the audiologist and the ear, nose and throat practitioner as designed by OTOCONSULT NV.

The customer shall be responsible for determining that the product is suitable for the customer’s use and that such use complies with any applicable laws.

The customer shall notify OTOCUBE in writing of any claimed defect in the product immediately upon discovery, and any such product shall be returned without undue delay at the customer’s risk to OTOCUBE, transportation charges prepaid, no later than six months from the original date of delivery.

This warranty does not cover the following situations.
OTOCUBE shall not be responsible for any breach in respect of the product supplied if:

(i) the product is used with other software than mentioned above;
(ii) the customer makes further use of such the product after defect has been discovered;
(iii) the defect or failure arises from the customer’s misuse;
(iv) the defect arises from any drawing, design or specification supplied by the customer or from other material or other property supplied by the customer, or from failure to supply such information or property, or from any parts or items that have not been completely manufactured by OTOCUBE;
(v) the defect arises out of the use of the product in conjunction with products or materials not reasonably contemplated by OTOCUBE;
(vi) the product has been repaired, modified or fitted by others than personnel authorised by OTOCUBE, and;
(vii) non-official OTOCUBE components or spare parts have been used;
(viii) defects resulting from the incorrect use (such as an application that is not listed in the user and operating instructions, etc.);
(ix) defects that result from repairs, modifications, disassembly of parts, cleaning operations etc. performed by anyone other than OTOCUBE or an authorized repair and service station of OTOCUBE;
(x) defects or damage resulting from transport, accidents, shocks etc. after purchase of the product;
(xi) defect or damage resulting from fire, earthquakes, floods, lightning, natural disasters, environmental pollution and problems with power supply;
(xii) defects resulting from careless or improper storage (such as keeping the product to high temperatures or humidity, or too large at harmful substances etc.), incorrect maintenance etc.;
(xiii) defects resulting from wrong adapters etc.;
(xiv) defects resulting from sand, mud etc. that in the housing of the product;
(xv) when changes are made to the purchase date, customer name, dealer name and/or the serial number on the warranty certificate;
(xvi) when the warranty certificate is not accompanied by proof of purchase.


If the product is determined to be defective, OTOCUBE shall at its discretion;
(i) repair or replace such defective product, and OTOCUBE shall have reasonable time to make such repairs or to replace such product or;
(ii) grant the customer a fair and proportionate price reduction for the delivery in question.

Any repair or replacement of the product shall not extend the standard six months period for notifying OTOCUBE of defects. This warranty applies only to the product; and does not include any accessories such as software, trolley, vibration damping sheet, manual etc.

Comments regarding the validity of the warranty:

This warranty is only valid if the warranty certificate is completely filled out by an authorized dealer in combination with the original sales receipt or invoice. Make sure that your company’s name, as well as the name of the dealer, and the serial number of the product, the year, month, and day of purchase is filled out on these documents. OTOCUBE reserves the right to refuse the free repair service if the guarantee certificate is not completely filled out or the attached proof of purchase has not the correct or complete information. No warranties, expressed or implied, by or in relation to written materials or software is given on the product.

Limitation of liability:

The liability under this warranty is limited to repair or replacement of the product. OTOCUBE can in no case be held liable for not-fully completed warranty certificates or proofs of purchase.

OTOCUBE does not accept liability for direct or indirect or consequential damages or loss, suffered by the customer, user or recipient or another arising out of any defects of the product. (including damages to users, recipients, cables, CI’s, analyzers, loss of profit, business interruption, loss of business information, loss of data etc.).

Of course the legal liability in the country the product is purchased are respected.
